1. Introduction

Welcome to FoxPaperGrove ("we," "us," or "our"). These Terms & Conditions ("Terms") apply to your use of our yacht charter services as well as your access to our website located at foxpapergrove.sbs, which is provided by FoxPaperGrove.

By reserving a yacht or using our Service, you consent to these Terms. Should you object to any part of these terms, you should not use the Service.

2. Service Overview

FoxPaperGrove offers a range of high-end yacht charter services, which include, but are not limited to:

• Yacht hire on a daily basis
• Evening sailing experiences
• Corporate getaways
• Exclusive celebrations
• Extended charter trips

Our services are offered based on availability and favourable weather conditions. We retain the flexibility to change or terminate services whenever necessary.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

• Have reached the age of 18 years or older
• Supply truthful and full details
• Remit the stipulated advance payment as indicated in your reservation confirmation
• Accept and comply with these Terms & Conditions

3.2 Confirmation

Your reservation is considered final only after we have received your payment and provided you with a confirmation in writing. We hold the authority to deny service to anyone at our sole discretion.

3.3 Availability

All charters are provided based on the availability of vessels and appropriate weather conditions. We will strive to meet your requested dates and times as closely as possible.

4. Payment Terms

4.1 Pricing

All listed prices are in € and comprise any pertinent taxes unless specified otherwise. Prices can be adjusted without prior notification.

4.2 Payment Schedule

• Initial Deposit: 50% of the overall cost of the charter, payable at the time of reservation
• Final Payment: Required to be paid in full 48 hours before the scheduled departure of the charter
• Incidental Expenses (if any): Payable upon the conclusion of the charter

4.3 Payment Methods

We accept several modes of payment, including major credit cards, bank transfers, and validated checks. Payments are processed using protected, encrypted means.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancelled more than 72 hours before departure: A full refund less transaction fees will be made
• For cancellations made 24-72 hours before departure: A 50% refund will be issued
• Cancellation less than 24 hours before departure: No return of payment will be made

5.2 Weather Cancellations

In case our captain deems weather conditions unsafe, we can:

• Propose a new date for the charter at no additional charge
• Issue a full refund when rescheduling is not feasible

5.3 Mechanical Issues

Should there be a mechanical failure with the yacht designated for your service, we will try to substitute it with an appropriate alternative. If substituting is not possible, a complete reimbursement will be provided.

6. Safety and Conduct

6.1 Safety Requirements

All guests must:

• Adhere to all directions from the crew
• Utilize the provided safety gear when mandated
• Inform about any health conditions that could impact their safety
• Stay within authorized areas of the vessel

6.2 Prohibited Items

The items not allowed on board include:

• Glassware
• Illegal drugs
• Firearms or any form of weaponry
• Excessive quantities of beverages (beyond reasonable personal consumption)
• Animals (unless prior approval is given)

6.3 Conduct

Passengers are expected to behave in a courteous manner. We hold the right to cease any charter prematurely without a refund in cases where a passenger's conduct constitutes a security threat or impairs the experience for others.

7. Liability and Insurance

7.1 Our Liability

We are only liable up to the amount that you have paid for your charter. We are not accountable for:

• Personal harm resulting from the negligence of passengers
• The loss or damage of personal belongings
• Indirect or punitive damages, or any losses that are a consequence of other events
• Delays brought about by weather or situations outside our influence

7.2 Insurance Coverage

Comprehensive marine insurance that covers our vessels and operations is held by us. It is the responsibility of passengers to ensure they have adequate travel and personal insurance.

7.3 Assumption of Risk

By taking part in our charter services, you understand that there are certain inherent hazards associated with maritime activities, and you assume full accountability for your safety and welfare.

8. Modifications and Itinerary Changes

We retain the right to adjust itineraries, paths, or timelines in response to weather conditions, for safety reasons, or due to operational needs. We will make an effort to arrange comparable alternative provisions.

9. Force Majeure

We are not responsible for hold-ups, cancellations, or alterations caused by events that are out of our hands, which include, but are not restricted to:

• Extreme weather conditions
• Natural disasters
• Governmental directives
• Port blockages
• Vehicular failures

10. Privacy and Data Protection

Your private data is managed in line with our Privacy Policy. Utilizing our services indicates that you consent to the compilation and use of your data as outlined in our Privacy Policy.

11. Intellectual Property

Our website content, which encompasses text, imagery, logos, and pictures, is protected under copyright and trademark statutes. Reproduction, distribution, or creating derivative content requires our explicit authorization.

12. Governing Law

The laws of Italy will govern these Terms, and any disputes should be settled in the courts situated in Viareggio, Italy.

13. Changes to Terms

We may alter these Terms from time to time. Any changes will be published on our platform with the date of the revision marked. Continued use of our services after such changes assumes your concurrence to the updated terms.
